Доброчесність як інструмент розвитку правосвідомості публічних службовців в умовах реформування державної служби

Анотація
Автором здійснено аналіз доброчесності як інструменту розвитку правосвідомості публічних службовців в реформування державної служби, що визначає його норми поведінки і формує правомірну модель кар’єрного розвитку в системі професіоналізації державної служби. Здебільшого дослідження доброчесності проводиться науковцями у сфері юридичної науки. Однак сьогодні даний термін має різновекторний контекстний підхід у законодавстві і широковживаний в публічному управлінні та адмініструванні: як оціночна характеристика діяльності державного органу влади; як вимога до конкурсу та кандидата-учасника конкурсу; як критерій відповідності посаді на державній службі; як превентивний засіб у боротьбі з корупцією через запровадження декларації доброчесності державних та публічних службовців та посадових осіб місцевого самоврядування; як перевірка на доброчесність; як сукупність етичних принципів та визначених законом правил на державній службі чи службі в органах місцевого самоврядування; як інструмент розвитку правової свідомості та правової культури публічних службовців. Автор робить висновок про юридизацію доброчесності як етичної категорії (тобто закріплення морального обов’язку як юридичний) в позитивний юридичний обов’язок публічних службовців в органах влади. З цією метою автор статті застосовує такі методи як аналіз, синтез, індукція, дедукція, абстрагування, конкретизація, узагальнення. Розв’язання проблеми розвитку правосвідомості публічних службовців автор вбачає через принцип доброчесності, законодавчо встановлених етичних регуляторів поведінки та стандартів моральних цінностей ЄС, зростання ролі двох інституцій – Національного агентства з питань запобігання корупції та Національного агентства України з питань державної служби в інституалізації стандартів доброчесності.Завантаження
